Welcome to the Checkout and Chillout LLC website ("Website"). These Terms of Service ("Terms") govern your access to and use of the Website and all luggage pickup, storage, transportation, and delivery services provided by Checkout and Chillout LLC, an Alabama limited liability company ("Checkout and Chillout," "Company," "we," "our," or "us").
By accessing our Website, requesting services, creating an account, or clicking "I Accept," "Book Now," "Reserve," "Checkout," or any similar button during the booking process, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, do not use our Website or services.
1. Our Services
Checkout and Chillout LLC provides temporary luggage pickup, storage, transportation, and delivery services for travelers, vacationers, and guests.
We are not a warehouse, moving company, common carrier, or insurer of your property.
2. Eligibility
You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to use our services.
3. Customer Responsibilities
You agree that:
- You own the luggage or have authority to store and transport it.
- All luggage is securely packed before pickup.
- All luggage is properly zipped, closed, and locked if desired.
- You have removed all prohibited items before pickup.
- You have provided accurate pickup and delivery information.
- You understand that Checkout and Chillout LLC does not inventory or verify the contents of your luggage.
You remain solely responsible for everything contained inside your luggage.
4. Prohibited Items
You may not place any of the following in luggage stored or transported by Checkout and Chillout LLC:
- Firearms
- Ammunition
- Explosives
- Illegal drugs
- Hazardous materials
- Flammable liquids
- Live animals
- Perishable food
- Cash or currency
- Jewelry
- Watches
- Precious metals
- Passports
- Birth certificates
- Prescription medications
- Controlled substances
- Artwork
- Collectibles
- Securities
- Cryptocurrency wallets
- Any item prohibited by law
We reserve the right to refuse service whenever prohibited items are suspected.
5. Inspection
Checkout and Chillout LLC does not routinely inspect luggage.
However, we reserve the right to refuse service, inspect luggage when legally permitted or required, or contact law enforcement if we reasonably believe luggage contains dangerous, illegal, or prohibited items.
6. Assumption of Risk
You understand and agree that transportation and temporary storage of luggage involves risks that cannot be completely eliminated.
These risks include, but are not limited to:
- Theft
- Fire
- Flood
- Water damage
- Vehicle accidents
- Mechanical failures
- Weather events
- Hurricanes
- Tropical storms
- Airline delays
- Acts of God
- Criminal acts by third parties
- Events beyond our reasonable control
By using our services, you voluntarily assume these risks.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Checkout and Chillout LLC shall not be liable for any loss, theft, delay, destruction, or damage to luggage or its contents except where directly caused by the Company's gross negligence or intentional misconduct.
Our total liability for any claim shall never exceed the lesser of:
- $200 per bag, or
- The total amount paid for the applicable service.
Under no circumstances shall Checkout and Chillout LLC be liable for:
- Consequential damages
- Incidental damages
- Special damages
- Lost profits
- Lost business opportunities
- Emotional distress
- Travel expenses
- Airline fees
- Hotel costs
- Missed reservations
- Damage to fragile items
- Damage to electronics packed inside luggage
- Damage to valuables packed inside luggage
- Normal wear and tear
- Damage to contents not visible during pickup
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability shall be limited only to the maximum extent permitted by law.
8. No Insurance
Checkout and Chillout LLC does not provide insurance for luggage or its contents.
Customers are encouraged to obtain their own travel, homeowners, renters, or personal property insurance.
9. Customer Indemnification
You agree to defend, indemnify, and hold harmless Checkout and Chillout LLC and its members, managers, officers, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys' fees arising out of or related to:
- Your breach of these Terms;
- The contents of your luggage;
- Your violation of any law;
- Any injury or property damage caused by your luggage or its contents;
- Claims by third parties regarding ownership of your luggage.
10. Delivery Authorization
If you instruct us to leave luggage with a hotel front desk, concierge, condominium office, vacation rental manager, property owner, designated individual, or at another location of your choosing, our responsibility ends immediately upon delivery to that location.
You assume all risk for the luggage after delivery.
11. Unclaimed Property
Luggage not claimed within thirty (30) days after the scheduled delivery or pickup date may be deemed abandoned, subject to applicable Alabama law.
Checkout and Chillout LLC may dispose of, donate, or sell abandoned property to recover unpaid charges.
12. Claims
Any claim for damage or loss must be submitted in writing within forty-eight (48) hours after delivery.
Failure to submit a timely claim may result in the claim being denied.
13. Force Majeure
Checkout and Chillout LLC shall not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, hurricanes, floods, severe weather, airline disruptions, road closures, government actions, labor disputes, pandemics, utility failures, or other force majeure events.
14. Payment
Payment is due as described during the booking process.
The cash price and online/card price are disclosed before booking. The online/card price is 3.5% higher than the cash price. Customers who pay onsite in cash pay the cash price.
We reserve the right to suspend or refuse service for unpaid balances.
15. Electronic Acceptance
By checking the required acceptance box and clicking "I Accept," "Book Now," "Reserve," "Checkout," or another confirmation button on our Website, you agree that:
- You have read these Terms of Service.
- You understand these Terms of Service.
- You agree to be legally bound by these Terms.
- Your electronic acceptance constitutes your legal signature under applicable electronic signature laws, including the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and any applicable Alabama laws governing electronic transactions.
16. Governing Law
These Terms shall be governed by the laws of the State of Alabama without regard to conflict of law principles.
17. Venue
Any legal proceeding arising from these Terms or the use of our services shall be brought exclusively in the state or federal courts located in Baldwin County, Alabama, to the extent permitted by law.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. Changes to These Terms
Checkout and Chillout LLC reserves the right to modify these Terms at any time.
Updated Terms will become effective immediately upon posting to this Website unless otherwise stated.
Your continued use of the Website or services after changes are posted constitutes your acceptance of the revised Terms.
